Cookie Policy

This Cookie Policy governs the use of cookies and similar tracking technologies deployed on the website operating at haverino.site (the "Site"), which is published and maintained by Havenrino Broadcasting (Pty) Ltd, a Proprietary Limited (Pty) Ltd trading as Havenrino Broadcasting, Телевещание ("Havenrino Broadcasting", "we", "us" or "our"), with its registered address at 58 Cradock Street, Wilderness Heights, 6530 George, South Africa. This policy is issued as a complement to our Privacy Policy and should be read together with it, in particular insofar as cookies constitute a means by which personal information is collected and processed within the meaning of the Protection of Personal Information Act, 4 of 2013 ("POPIA").

I. Definitions

For the purposes of this policy, the following terms shall bear the meanings assigned to them below. "Cookie" means a small text file placed on the hard drive or browser storage of a user's terminal equipment by a web server, which is thereafter read by that or another server each time the terminal equipment accesses the Site, and which enables the recognition of the user's device across sessions. "Session Cookie" means a cookie that is automatically deleted upon the closure of the user's browser. "Persistent Cookie" means a cookie that remains stored on the user's device for a predetermined period, or until manually deleted, and which survives the closure of the browser. "Necessary Cookies" means those cookies without which the Site, or material functions thereof, cannot be delivered, including cookies required to maintain security, load balancing, and the integrity of form submissions. "Analytics Cookies" means cookies used to collect aggregated or pseudonymised statistical information concerning the manner in which visitors use the Site, for the purpose of improving its functioning and content. "Marketing Cookies" means cookies used to track visitors across the Site and, potentially, other websites, for the purpose of displaying advertisements or content considered relevant to the individual user's interests. "User" or "data subject" means any natural person who accesses or interacts with the Site. "Consent" bears the meaning given to it under POPIA, namely any voluntary, specific and informed expression of will in terms of which permission is given for the processing of personal information.

II. Application of this Policy to the Site's Functions

Havenrino Broadcasting operates the Site principally to provide information regarding its broadcasting services, to enable prospective and existing viewers, advertisers and partners to make contact with the business through the contact form hosted on the Site, and to permit interested users to subscribe to email communications concerning programming updates, broadcast schedules and related announcements. Cookies are deployed across these functions in the manner described in Section IV below. Where a cookie is strictly necessary to permit the contact form or subscription mechanism to operate — for example, to prevent duplicate submissions or to protect the submission process against automated abuse — such cookie is treated as a Necessary Cookie and is not subject to prior consent. Where a cookie serves any purpose beyond such strict necessity, including the measurement of Site traffic or the tailoring of promotional content, consent shall first be obtained in the manner described in Section VI.

III. Categories of Cookies Used

The Site employs cookies falling within three categories, consistent with the consent mechanism presented to users upon first accessing the Site. The first category, Necessary Cookies, includes cookies that preserve the state of the cookie-consent banner itself, cookies that maintain the integrity of a session while a user completes and submits the contact form, and cookies used to detect and prevent fraudulent or automated form submissions. These cookies are exempt from the requirement of prior consent because they are indispensable to the delivery of the service requested by the user, in accordance with the reasoning underlying section 11 of POPIA regarding processing necessary for the conclusion or performance of a transaction requested by the data subject. The third category, Marketing Cookies, includes cookies that may be used, where enabled, to recognise a returning visitor for the purpose of presenting content or promotional material considered relevant to that visitor's prior interaction with the Site, and, where applicable, to measure the effectiveness of such promotional material.

IV. Specific Cookies and Retention Periods

Necessary Cookies associated with the operation of the cookie-consent banner are ordinarily retained for a period of twelve months, after which the user's preference will be requested afresh. Necessary Cookies associated with the submission of the contact form are session cookies and are deleted automatically upon closure of the browser or upon completion of the submission process, whichever occurs first. Analytics Cookies, where enabled by the user's consent, are ordinarily retained for a period not exceeding twenty-four months, and are configured, where the underlying analytics provider permits, to truncate or mask the visitor's IP address prior to storage. Marketing Cookies, where enabled by the user's consent, are ordinarily retained for a period not exceeding twelve months. Where a third-party service provider is responsible for setting a cookie falling within the Analytics or Marketing categories, the retention period applied is that determined by such provider's own published policy, and the user is encouraged to consult the relevant provider's documentation for further detail.

V. Third-Party Cookies

Certain cookies placed on the Site may originate from third-party service providers engaged by Havenrino Broadcasting to furnish analytics or content-delivery functionality. Such third parties act, in relation to the personal information collected by way of their cookies, either as independent responsible parties or as operators acting on the instruction of Havenrino Broadcasting, depending on the nature of the service concerned and the terms agreed between Havenrino Broadcasting and the provider in question. Havenrino Broadcasting does not control the cookies placed by such third parties beyond the configuration options made available to it, and the user is advised that the privacy and cookie practices of such third parties are governed by their own respective policies.

VI. Consent and Withdrawal of Consent

Upon first accessing the Site, the user is presented with a cookie-consent mechanism permitting the user to accept all cookies, to decline all cookies other than Necessary Cookies, or to select individually the categories of Analytics and Marketing Cookies to which the user consents. No Analytics or Marketing Cookie is set prior to the user's affirmative selection. A user who has given consent may withdraw that consent at any time by amending the relevant preference through the cookie-preference control accessible from any page of the Site, or by adjusting the cookie settings of the browser employed to access the Site so as to block or delete cookies already stored. VII. Browser-Level Controls

In addition to the consent mechanism described above, the majority of internet browsers permit a user to view, manage, block or delete cookies already stored on the user's device, and to configure the browser so as to refuse the placement of new cookies generally or from specified domains. VIII. Relationship to Personal Information Processed via the Contact Form and Email Subscription

Where a cookie enables the correlation of information submitted through the contact form, or the confirmation of a subscription to email communications, with a particular browsing session, the information so correlated is processed as personal information subject to the terms of our Privacy Policy, and the legal bases, retention periods and data subject rights described in that document apply equally to information collected in this manner. This Cookie Policy addresses only the mechanism of cookie-based collection and does not detract from, or narrow, the protections afforded under the Privacy Policy in respect of the substantive personal information collected through those two channels.

IX. Amendments to this Policy

Havenrino Broadcasting reserves the right to amend this Cookie Policy from time to time, whether to reflect a change in the cookies deployed on the Site, a change in applicable law, or a change in the third-party service providers engaged. The version published on the Site at any given time shall be the version in force, and material changes affecting the categories of cookies deployed or the manner of obtaining consent will, where practicable, be brought to the attention of returning users by way of a renewed consent prompt.
