Terms of Use

These Terms of Use ("Terms") govern access to and use of the website operating under the domain haverino.site (the "Site") and the broadcasting-related services, informational content, and communications offered thereon by Havenrino Broadcasting (Pty) Ltd, a Proprietary Limited (Pty) Ltd duly incorporated under the company laws of the Republic of South Africa, trading as Havenrino Broadcasting, Телевещание ("Havenrino Broadcasting", "the Company", "we", "us" or "our"). By accessing or using the Site, the person so accessing or using it ("the User", "you") signifies acceptance of these Terms in their entirety. Should any User not agree to be bound by these Terms, such User must refrain from accessing or using the Site.

I. Definitions and Interpretation

In these Terms, unless the context indicates otherwise, the following expressions shall bear the meanings assigned to them below, and cognate expressions shall bear corresponding meanings:

"the Company" or "Havenrino Broadcasting" means Havenrino Broadcasting (Pty) Ltd, registration number 4774892981, with its registered address at 58 Cradock Street, Wilderness Heights, 6530 George, South Africa;

"the Site" means the website located at haverino.site and all subdomains, pages, and digital properties operated by the Company in connection with its broadcasting and media-related activities;

"Services" means the informational, editorial, promotional and subscription-based broadcasting content, programme listings, news updates and related material made available by the Company through the Site, including any content delivered via the email subscription service described herein;

"Contact Form" means the electronic form made available on the Site through which a User may submit an enquiry, complaint, or request to the Company;

"Subscription Service" means the optional electronic mailing service whereby a User, by furnishing an email address, elects to receive periodic communications, newsletters, or broadcast-related updates from the Company;

"User" means any natural or juristic person who accesses, browses, or otherwise makes use of the Site or the Services;

"POPIA" means the Protection of Personal Information Act 4 of 2013, as amended from time to time, together with any regulations promulgated thereunder;

"Content" means all text, graphics, logos, audio, video, programme schedules, articles, trade marks and other material appearing on the Site, in whatever form.

II. Nature of the Services

Havenrino Broadcasting operates the Site as a platform through which it disseminates broadcasting-related news, programme information, and editorial content to the public. The Company further offers, through the Subscription Service, a facility whereby Users may elect to receive email communications concerning its broadcasting activities, programme announcements and related matters. Nothing on the Site constitutes a broadcasting licence, a contractual offer to broadcast on behalf of a User, or any warranty as to the availability, timing, or content of any particular broadcast, save as may be separately and expressly agreed in writing between the Company and a User.

III. The Contact Form and Subscription Service

The Site provides a Contact Form through which a User may transmit to the Company such personal information as the User's name, email address, and the substance of any enquiry or communication the User wishes to make. Submission of the Contact Form constitutes an instruction to the Company to receive, process, and respond to the communication so submitted, and the User warrants that any information furnished thereby is true, accurate, and not submitted with any unlawful or malicious intent.

The Subscription Service permits a User to furnish an email address for the purpose of receiving periodic communications from the Company. A User who subscribes may withdraw such consent and unsubscribe at any time by way of the unsubscribe mechanism contained in each communication, or by written notice to [email protected]. The Company shall give effect to any such withdrawal within a reasonable period, and in any event in accordance with the requirements of POPIA and applicable direct-marketing legislation.

IV. Acceptable Use

A User shall not use the Site or the Contact Form to transmit any content that is unlawful, defamatory, obscene, threatening, or otherwise objectionable; to impersonate any person or entity; to introduce any virus, malicious code, or other harmful material; to attempt unauthorised access to the Company's systems or networks; or to use any automated means to scrape, harvest, or otherwise extract Content from the Site without the Company's prior written consent. The Company reserves the right, at its sole discretion, to restrict, suspend, or terminate any User's access to the Site or the Services in the event of a breach of this clause.

V. Intellectual Property

All Content appearing on the Site, including without limitation the Havenrino Broadcasting name, associated logos, programme schedules, articles, and audio-visual material, is the property of the Company or its licensors and is protected by the copyright, trade mark, and other intellectual property laws of the Republic of South Africa and, where applicable, of other jurisdictions. No Content may be reproduced, distributed, modified, or otherwise exploited without the prior written consent of the Company, save to the extent that such use constitutes fair dealing as contemplated by the Copyright Act 98 of 1978.

VI. Disclaimer and Limitation of Liability

The Site and its Content are made available on an "as is" and "as available" basis. Whilst the Company takes reasonable measures to ensure that information published on the Site, including programme schedules and broadcasting announcements, is accurate and current, the Company gives no warranty, express or implied, as to the completeness, accuracy, or timeliness of any such information, and shall not be liable for any loss or damage arising from a User's reliance thereon. To the fullest extent permitted by the laws of the Republic of South Africa, the Company excludes liability for any indirect, incidental, or consequential loss arising out of or in connection with a User's access to or use of the Site, save where such liability cannot lawfully be excluded, including liability arising from gross negligence or wilful misconduct on the part of the Company.

VII. Personal Information

The Company processes personal information submitted through the Contact Form and the Subscription Service in accordance with its Privacy Policy, which forms an integral part of these Terms and is available on the Site. Such processing is undertaken in compliance with POPIA, and Users are encouraged to consult the Privacy Policy for a full account of the manner in which their personal information is collected, used, retained, and safeguarded, and of the rights available to them as data subjects.

VIII. Third-Party Links

The Site may from time to time contain links to third-party websites, including broadcasting partners, advertisers, or affiliated media entities. The inclusion of any such link does not constitute an endorsement by the Company of the content, products, or services offered on the linked site, and the Company accepts no responsibility for the content or practices of any third-party website.

IX. Amendment of these Terms

The Company reserves the right to amend, vary, or update these Terms at any time, and any such amendment shall take effect upon publication on the Site. Continued use of the Site or the Services following such publication shall constitute the User's acceptance of the Terms as amended. Users are advised to review these Terms periodically.

X. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms, or the use of the Site or Services, shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

Should any provision of these Terms be found by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, such provision shall be severed from the remainder of these Terms, which shall continue in full force and effect. No relaxation, indulgence, or extension of time granted by the Company shall constitute a waiver of any right under these Terms. These Terms, together with the Privacy Policy and Cookie Policy published on the Site, constitute the entire agreement between the User and the Company in respect of the subject matter hereof. These Terms are effective as of 2026.
